Title VI and ADA Complaint Procedure

Richmond Community Services is the recipient of a Federal Transit Administration (FTA) grant. Through this grant a portion of our fleet is paid for with Grant Money. Part of the requirement to participate in the program requires our company (Richmond Community Services) to notify our riders of their right to complain about the Transportation Services that we provide.

Notifying the Public of Rights under Title VI Richmond Community Services operates its programs and services without regard to race, color, or national origin, in accordance with Title VI of the Civil Rights Act of 1964. To obtain additional information about your rights under Title VI, contact Richmond Community Services, 272 North Bedford Road, Mount Kisco, NY 10549 - 914-471-4100. Attn: Director of Operations/Facilities Manager. If you believe you have been discriminated against on the basis of race, color, or national origin by Richmond Community Services you may file a Title VI complaint by completing, signing, and submitting the agency's Title VI Complaint Form. How to file a Title VI complaint with Richmond Community Services: 1. To obtain a Complaint Form from Richmond Community Services, Contact: Richmond Community Services 272 North Bedford Road, Mount Kisco, NY 10549. 2. In addition to the complaint process at Richmond Community Services, complaints may be filed directly with the Federal Transit Administration, Office of Civil Rights, Region VII, 901 Locust Street, Suite 404, Kansas City, MO 64106 3. Complaints must be filed within 180 days following the date of the alleged discriminatory occurrence and should contain as much detailed information about the alleged discrimination as possible. 4. The form must be signed and dated, and include your contact information. If information is needed in another language, contact 914-471-4100.

Title VI and ADA Complaint Procedure Richmond Community Services Title VI and American's with Disabilities (ADA) Complaint Procedure is made available in the following locations: (check or list all that apply) • Hard copy in the central office • Intake/Welcome Packet Any person who believes she or he has been discriminated against on the basis of race, color, or national origin by Richmond Community Services may file a Title VI complaint by completing and submitting the agency's Title VI Complaint Form. Richmond Community Services will make reasonable accommodations and take information verbally if the complainant requires this accommodation. Richmond Community Services investigates complaints received no more than 180 days after the alleged incident. Richmond Community Services will process complaints that are complete. Once the complaint is received, Richmond Community Services will review it to determine if our office has jurisdiction. The complainant will receive an acknowledgement letter informing her/him whether the complaint will be investigated by our office. Richmond Community Services has 45 days to investigate the complaint. If more information is needed to resolve the case, Richmond Community Services may contact the complainant. The complainant has 15 business days from the date of the letter to send the requested information to the investigator assigned to the case. If the investigator is not contacted by the complainant or does not receive the additional information within 15 business days, the case can be administratively closed. A case can be administratively closed also if the complainant no longer wishes to pursue their case. After the investigator reviews the complaint, she/he will issue one of two (2) letters to the complainant: a closure letter or a letter of finding (LOF). • A closure letter summarizing the allegations and states that there was not a Title VI violation and that the case will be closed. See sample letter attached. • A letter of finding (LOF) summarizing the allegations and the interviews regarding the alleged incident, and explaining whether any disciplinary action, additional training of the staff member, or other action will occur. If the complainant wishes to appeal the decision, she/he has 21 days after the date of the letter or the LOF to do so. A person may also file a complaint directly with the Federal Transit Administration, at FTA Office of Civil Rights, 1200 New Jersey Avenue SE, Washington, DC 20590.
